Under the Alternative Dispute Resolution Act, 2010 (Act 798), arbitration and mediation offer a faster, more confidential, and often less adversarial route to resolution than litigation. We use arbitration, mediation and negotiation where they offer a more effective path to resolution than litigation. ADR is at its most useful where confidentiality, relationship preservation and commercial continuity are non-negotiable.
